Workers' Compensation Class Codes Related to Assisted Living

Employees are grouped into classification codes based on what they do for their job. The National Council on Compensation Insurance (NCCI) currently utilizes nearly 800 class codes to help insurance companies categorize employees. Insurance companies create a manual rate for each class code in order to price a policy.

Properly classifying workers is an important part of the quote process. Mis-classified employers may end up paying too much for coverage or owing too much after an audit.

Restaurant- Full Service

Class Code 9083
Fast Food Restaurants- All Employees

Food service operations are typically divided between those that are classified as fast food service versus those that are full-service food service. Traditional restaurants typically have servers who wait on customers and receive gratuity or tips. Fast food restaurants will typically fall under the 9083 classification unless state specific rules require an alternate code. These types of restaurants could include standard fast food providers serving hamburgers, tacos, pizza, and sandwiches. Gratuity is generally not expected with fast food.

Restaurants who receive more than 50% of their revenue from the sale of alcoholic beverages such as beer, wine, or liquor typically belong under class code 9084- Bar classification. This class is often used for bars, nightclubs, lounges, taverns, etc.

Alternative State Class Codes for Restaurants:

Sometimes a state will deviate from the industry class code recommended by NCCI. Instead of the NCCI code, they may require the utilization of a state specific class code for certain business segments.
